I have read and understand this Agreement and I am aware that by reading
this Agreement I may be waiving certain legal rights, including the right to sue.
This Agreement shall be binding on me and my heirs, legal representatives, and
assigns.
This Waiver and Release Agreement must be completed before you may participate in any League activities.
In consideration for my participation in The Temecula Pickleball League I, my heirs, personal representatives and assigns agree to release, indemnify and hold harmless The Temecula Pickleball League, its employees, representatives, and volunteers from any and all claims, demands, liabilities, causes of action (including attorney fees and costs up through an appeals) whether by law of equity, by reason of any injury, death or damage to my person or persons or damage to or destruction of any property resulting from my participation in activities with The Temecula Pickleball League or arising from The League’s negligence acts, errors or omissions or intentional acts. I understand that my participation may involve certain risks and danger to my person or property, and with this knowledge I assume all risks and dangers from participation in activities with The Temecula Pickleball League.
I (or my parent/legal guardian below) am over the age of eighteen (18) and understand that tennis, pickleball, sports conditioning and physical activity carry with them certain inherent dangers and risks that cannot be eliminated regardless of the care taken to avoid injuries. I understand and assume full responsibility for any risk of bodily injury, death, or property damage or destruction related to my participation or attendance whether caused by the negligence of The Temecula Pickleball League or otherwise.
I authorize and consent to the administration of first aid and any other medical treatment that is determined necessary in the event of any injury or illness while participating in League activities. I have appropriate insurance, or, if not, I agree to pay all costs of medical services incurred on my behalf. I recognize that The Temecula Pickleball League does not have trainers or medical personnel on site during matches. I authorize The Temecula Pickleball League to contact medical transportation and use of medical emergency services in the event of an accident, illness or injury and agree to assume responsibility for all costs incurred.
I agree and grant The Temecula Pickleball League the irrevocable right, with or without my knowledge, to film, tape, photograph, record, exhibit, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, distribute, broadcast, webcast, stream, prepare derivative works from or otherwise preserve, use and/or exploit in any format and/or manner now known or hereafter developed, whether commercial or non-commercial in nature (collectively, the “Use and Materials”): (1) my participation or attendance in The Temecula Pickleball League; and (2) my name, likeness, signature, voice, conversation, sounds, biographical data and/or any other information or material secured in connection with my participation or attendance in The Temecula Pickleball League.
I agree that The Temecula Pickleball League has the right to the Use and Materials to promote The Temecula Pickleball League. The Use and Materials shall not be identified as or represented to be an endorsement by me of any product, service or company and I acknowledge and agree that I shall not be entitled to receive any compensation whatsoever in connection with the exercise of the Use and Materials.
I have read and understand this Waiver and Release and fully understand its terms and conditions including that I have given up substantial rights by joining the league and agreeing to this Waiver and Release which is governed to and enforceable in accordance with the laws of the State of California. If any provision of this Waiver & Release should be found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
